COINBASE HUGE LEGAL WIN
Coinbase has secured a significant legal win in its ongoing battle with the SEC, as Judge Katherine Polk Failla of the Southern District of New York granted an interlocutory appeal. This rare move allows Coinbase to challenge key aspects of the SEC’s claims before the case is fully resolved, temporarily halting proceedings. The appeal will be reviewed by the Second Circuit Court of Appeals, focusing on whether digital assets traded on Coinbase qualify as “investment contracts” under the Howey test, a legal standard for identifying securities.
The SEC accuses Coinbase of operating as an unregistered exchange and broker dealer, as well as selling unregistered securities through its staking program, which lets users earn rewards by locking up crypto. Coinbase’s legal team argues that the regulator’s claims don’t align with current securities laws.
Over the strenuous objection of @SECGov, Judge Failla has GRANTED our motion for leave to pursue an interlocutory appeal and STAYED the district court litigation. We appreciate the Court's careful consideration. On to the Second Circuit we go.
